Who we are
Clarion Hearing Aids is run by Michael Tuck, a sole trader (ABN 24 669 389 835), from 119 Montague Street, North Wollongong NSW 2500, Australia. In these terms, “we”, “us” and “Clarion” mean Michael Tuck trading as Clarion Hearing Aids. “You” means the person placing the order.
The product
We sell the Clarion Clarity S3, supplied as a complete set: two hearing aids (left and right), a charging case, a USB-C cable, ear tips, wax guards, a cleaning brush, a printed user manual and a signed Certificate of Warranty. The product is intended for adults with perceived mild to moderate hearing difficulty. It is not intended to diagnose, treat, cure or prevent any disease. If you have concerns about your hearing, please consult a healthcare professional.
The aids are set up with the free FORSOUND app, which is provided by a third party. Your use of the app is also subject to the app provider’s own terms. You can also change the volume and listening settings on the aids themselves.
Information on our website
We take care to describe the product accurately. Information on our website, in our chat assistant and from our phone assistant is general product information, not medical advice. If anything we say is unclear, please call or email us before you order.
Orders
Your order is an offer to buy. We accept it when we email you an order confirmation. If we cannot fulfil an order, for example because of a pricing error, we will tell you promptly and refund anything you have paid in full.
Prices and payment
All prices are in Australian dollars and include delivery within Australia. Clarion is not registered for GST, so no GST is included in or added to our prices, and our invoices are not tax invoices.
You pay at checkout using one of the payment methods shown there. Payments are processed securely by our payment providers, and we never see or store your full card details. Afterpay, PayPal Pay in 4 and Zip are provided by those companies under their own terms.
With Try first, you pay $500 at checkout and the $1,118 balance by the invoice we email 14 days after delivery, due 7 days later. It is the same $1,618. The details are under Try first in our Refund policy.
We do not bill private health funds or government hearing programs, and we cannot promise that any fund will pay a benefit for your purchase.
From time to time we change our prices or offers. The price you pay is the price shown when you place your order.
Delivery
Delivery is covered by our Shipping policy. Ownership of the goods passes to you once we receive full payment. The risk of loss or damage passes to you on delivery.
Money-back trial, returns and warranty
Our 90-day money-back trial, returns, refunds and the 3-year warranty, including advance replacement, are set out in our Refund policy. The trial and the warranty both start on the day your complete set is delivered.
Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Our liability
To the extent the law allows, we are not liable for loss that was not reasonably foreseeable when you placed your order, or for loss caused by using the product other than as the user manual describes. This does not limit your rights under section 08.
